PV1 Introduction

Provider is ("We" are) committed to protecting and respecting your privacy. The Privacy Policy (together with our Website Terms of Use and any other documents referred to on it) sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

By submitting data to Provider you consent that your data may be used in accordance with the terms of the Privacy Policy.

For the purpose of the Data Protection Act 1998 ("Act"), the data controller is Provider.

Defined terms not expressly defined in the Privacy Policy are defined in the modules that make up the Agreement and the Developer Agreement (in particular the Basic Access module).

PV2 Information We May Collect from You

We may collect and process the following data about you:

  • Information that you provide by filling in forms on our site (as defined in the Website Terms of Use). This includes information provided at the time of registering to use our site, subscribing to our service, posting material or requesting further services. We may also ask you for information when you report a problem with our site.
  • If you contact us, we may keep a record of that correspondence.
  • We may also ask you to complete surveys that we use for research purposes, although you do not have to respond to them.
  • Details of transactions you carry out through our site and of the fulfilment of your orders.
  • Details of your visits to our site including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.
  • For certain transactions, we also collect selected financial information such as credit card details.
  • For transaction volumes over a certain limit, we are legally required to report some personally identifiable information to the authorities.
  • For verification purposes we reserve the right to request proof of identification in an offline format. Such proofs of identification may be stored electronically on our servers in order to comply with our legal and regulatory obligations.
  • Your IP address and access times may be tracked against your user ID for the dual purposes of preventing fraud and creating an audit trail when using the services of Provider (including the Service and the Provider Service).
  • Competitions may be made available on our site from time to time. You do not have to participate in these, however if choose to you may be asked to disclose some Personal Information. At the time of entering the competition it will be made clear to you who will have access to your personal information and why. You are not obliged to continue with your competition entry, however if you do so you accept that you may receive a prize.

PV3 IP Addresses, Cookies and Click-through URLs

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our partners. This is statistical data about our users' browsing actions and patterns, and does not identify any individual.

For the same reason, we may obtain information about your general Internet usage by using a cookie file which is stored on the hard drive of your computer. Cookies contain information that is transferred to your computer's hard drive. They help us to improve our site and to deliver a better and more personalised service. They enable us:

  • To estimate our audience size and usage pattern.
  • To store information about your preferences, and so allow us to customise our site according to your individual interests.
  • To speed up your searches.
  • To recognise you when you return to our site.

You may refuse to accept cookies by activating the setting on your browser that allows you to refuse the setting of cookies. However, if you select this setting you may be unable to access certain parts of our site. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you log on to our site.

We may use third party cookies to help us improve our site design and user experience. Please note that our partners may also use cookies, over which we have no control.

Our Web pages contain electronic images known as Web beacons (sometimes called single-pixel gifs) and are used along with cookies to compile aggregated statistics to analyze how our site is used and may be used in some of our emails to let us know which emails and links have been opened by recipients. This allows us to guage the effectiveness of our customer communications and marketing campaigns.

We may occasionally use a "click-through URL". When you click one of these URLs, you pass through our web server before arriving at your final destination. We track click-throughs to help us improve the user experience, determine your interest in particular topics and measure the effectiveness of our customer communications.

Please be aware that Provider is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave our site to read the privacy statements of each and every website that collects personally identifiable information. The Privacy Policy applies solely to information collected on our site.

PV4 Where We Store Your Personal Data

The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area ("EEA"). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff maybe engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. By submitting your personal data, you agree to this transfer, storing or processing. Provider will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this privacy policy.

All information you provide to us is stored on our secure servers. Your account login, personal details and all transactions are secured using Secure Socket Layer ("SSL") technology with high security 128bit encryption. Where we have given you (or where you have chosen) a password that enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

PV5 Uses Made of the Information

We use information held about you in the following ways:

  • To ensure that content from our site is presented in the most effective manner for you and for your computer.
  • To provide you with information, products or services that you request from us or which we feel may interest you, where you have consented to be contacted for such purposes.
  • To carry out our obligations arising from any contracts entered into between you and us.
  • To allow you to participate in interactive features of our service, when you choose to do so.
  • To notify you about changes to our service.

We will not disclose your information to any other third parties except with your explicit permission or as permitted in provision PV6 of the Privacy Policy.

PV6 Disclosure of Your Information

We may disclose your personal information to any member of Provider's group of companies, which includes Provider's subsidiaries, Provider's ultimate holding company and the subsidiaries of that holding company.

We may disclose your personal information to third parties:

  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If Provider or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets.
  • In order: (i) to comply with any legal obligation (including reporting obligations under fraud, anti-money laundering, and counter terrorist financing law); (ii) to order, enforce or apply our website terms of use; (iii) to order, enforce or apply provisions of the Agreement or Developer Agreement; or (iv) to protect the rights, property, or safety of Provider, our customers, or others.
  • For the purposes of fraud protection and credit risk reduction but only to entities such as banks and providers of credit card processing and verification services including credit reference agencies. A record of such enquiries may be left on your file with these agencies.

PV7 Your Rights

Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

PV8 Access to Information

The Act gives you the right to access information held about you. Your right of access can be exercised in accordance with the Act and should you wish to exercise this right please contact us. Any access request may be subject to a fee of £10 to meet our costs in providing you with details of the information we hold about you.

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services please cotnact us. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

PV9 Changes to the Privacy Policy

Any changes we may make to the Privacy Policy in the future will be posted on this page and, where appropriate, notified to you by e-mail. If we are going to use your personal information in a manner different from that stated at the time of collection we will notify you via e-mail. You will have a choice whether or not to allow us to use your information in this new manner. However, if your account with Provider has been suspended or closed then you will not be contacted and your information will not be used in this new manner.

PV10 Conflict between Agreements and Privacy Policy

Where there is a conflict between the Privacy Policy and an explicit provision of the Agreement or the Developer Agreement, that provision will override the Privacy Policy.

PV11 TRUSTe Statement

Ixaris Systems Ltd has been awarded TRUSTe's Privacy Seal signifying that this privacy policy and practices have been reviewed by TRUSTe for compliance with TRUSTe's program requirements including transparency, accountability and choice regarding the collection and use of your personal information. The TRUSTe program covers information collected through this Web site.
